We at Osselaer believe that the most important aspect of our collection
practice is consistency. We will, with Board approval, establish
the procedures to collect all past dues assessments. Osselaer has
a recommended schedule for the collection of past dues assessments, and
generally, unless a special situation exists, the majority of homeowners
respond to prompt collection procedures and are not likely to repeat
when they realize how promptly we respond to such inaction.
Association dues are due on the first, and considered delinquent on the
fifteenth or thirtieth of each month, depending on your governing
documents. We recommend the following schedule:
"Miscellaneous
Amount" Letter:
0 days from Delinquency
30 days from Due Date
To be used for collecting any amount owed less than one month's
assessment. No more than two (2) consecutive Miscellaneous Amount
letters will be given to a homeowner in the attempt to collect a
miscellaneous amount. This letter incorporates the
"Full-Federal Fair Debt Act" verbiage, and requires a thirty
(30) day waiting period for either payment or dispute before moving
forward with any additional collection proceedings.
"A"
Letter:
0 days from Delinquency
30 days from Due Date
First letter to be used for collecting any amounts greater than one
month's assessment, as well as the third attempt to collect a
miscellaneous amount. This letter incorporates the
"Full-Federal Fair Debt Act" verbiage, and requires a thirty
(30) day waiting period for either payment or dispute before moving
forward with any additional collection proceedings.
"B"
Letter:
30 days from Delinquency
60 days from Due Date
Second letter to be used for collecting amounts for homeowners who have
refused to respond or comply with the previous "A"
letter. This letter incorporates the "Short-Federal Fair Debt
Act" verbiage, and gives the delinquent homeowner ten (10) days to
make current their account or face having a lien placed against their
property.
"IC"
Letter (Intent to Collect):
40 days from Delinquency
70 days from Due Date
Third and FINAL "In-house" collection letter to be used for
collecting the previous "B" letter. This letter is to be
mailed subsequent to a Lien being placed against the homeowner's
property.
Turnover
to Collection Attorney:
50 days from Delinquency
80 days from Due Date.
